1. Introduction
These Terms of Service (“Terms”) govern your access to and use of Imagibrary (“we”, “us”, or “our”), including the Imagibrary mobile application, website, and related services (collectively, the “Services”). By creating an account, making a purchase, or using our Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services.
2. Eligibility
- You must be at least 13 years old to use the Services.
- Users under 18 years old must have parental or guardian consent.
- By using the Services, you represent that you meet these eligibility requirements.
3. Accounts
- You must create an account to use certain features.
- You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
- You agree to provide accurate and complete information when creating your account.
- We may suspend or terminate your account if you violate these Terms.
4. Subscriptions and Payments
- Some Services require a paid subscription or purchase of story credits.
- Payments are processed through Apple App Store, Google Play Store, or Stripe.
- All purchases are final, except as required by law or the applicable platform’s refund policy.
- Subscriptions renew automatically unless canceled before the renewal date.
- You are responsible for managing your subscription through the platform where you purchased it.
5. User Content
- You may submit text, prompts, audio, images, or other content (“User Content”) to generate stories, illustrations, or narration.
- You retain ownership of your User Content.
- By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, process, store, transmit, and display it solely to operate, maintain, and improve the Services (e.g., rendering, saving to your library, troubleshooting).
- You are responsible for ensuring your User Content does not violate any laws or third-party rights.
- We may remove or restrict User Content that violates these Terms.
6. AI-Generated Content and Ownership
Our Services use artificial intelligence (AI) to generate stories, illustrations, narration, and other outputs (“Outputs”) based on your inputs.
- You own all rights, title, and interest in the Outputs you generate.
- You may use, share, publish, or distribute the Outputs for any purpose, including commercial use, without obligation to us.
- We do not claim ownership over Outputs.
- You grant us a limited license to host, process, and display Outputs solely to operate the Services (e.g., save to your library, enable re-downloads, provide customer support).
Disclaimers About Outputs
- Outputs may contain errors, inconsistencies, or unintended results and are provided “as is.”
- You are solely responsible for reviewing and using Outputs appropriately, including ensuring they do not infringe third-party rights or violate laws.
- Imagibrary disclaims all responsibility and liability for any claims, damages, or losses arising from your use, distribution, or reliance on Outputs.
6A. Voice Cloning
- Imagibrary may allow narration using synthetic voices, including custom voices (“Cloned Voices”).
- By providing audio samples or other inputs to create a Cloned Voice, you represent and warrant that:
- You have the legal right and necessary permissions to use that voice.
- You will not upload or attempt to clone another person’s voice without their consent.
- You will not use Cloned Voices to impersonate others, mislead, or cause harm.
- Your Cloned Voice and audio samples are stored and processed in accordance with our Privacy Policy.
- You grant us a limited license to process and store your voice data solely to generate speech and operate the Service.
- We may suspend or terminate access to Cloned Voice features if we detect misuse.
7. Prohibited Uses
You agree not to use the Services to:
- Violate any laws or regulations.
- Upload or input personal data of children (e.g., full names, addresses) without proper consent.
- Infringe intellectual property, privacy, or other rights of others.
- Harass, exploit, or harm others, including through deceptive or manipulative use of Outputs or Cloned Voices.
- Circumvent technical restrictions, security measures, or payment requirements.
- Interfere with or disrupt the Services.
8. Intellectual Property
- Imagibrary, including trademarks, logos, software, design, and content (excluding User Content and Outputs), is owned by us and protected by law.
- You may not copy, distribute, or create derivative works of our IP without our written permission.
- Any feedback or suggestions you provide may be used by us without obligation.
- For clarity: Section 8 does not apply to AI-generated Outputs, which are owned by you as described in Section 6.
9. Termination
- We may suspend or terminate your account and access to the Services for violation of these Terms, fraudulent/harmful activities, or failure to pay fees.
- You may stop using the Services and request account deletion at any time.
10. Disclaimers
- The Services (including Outputs and Cloned Voices) are provided on an “as is” and “as available” basis.
- We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee uninterrupted or error-free operation of the Services.
11. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or lost profits, arising out of or relating to your use of the Services, Outputs, or Cloned Voices. Our total liability for any claim will not exceed the amount you paid for the Services in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services, Outputs, or Cloned Voices; (b) your User Content or audio samples; (c) your violation of these Terms or applicable laws; or (d) any allegation that your Outputs infringe or violate third-party rights.
13. Governing Law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles. Disputes will be resolved exclusively in the state or federal courts located in Mecklenburg County, NC, unless otherwise required by law.
14. Changes to These Terms
We may update these Terms periodically. The date at the top shows the latest version. Material changes will be communicated via in-app notice, email, or website banner. Continued use after changes means acceptance.
